Terms of Service

These Terms of Service ("Terms") govern your use of BuyerLens. BuyerLens is operated by FALAH ENTERPRISES PTY LTD, ABN 11 699 139 225 ("we", "us"). By creating an account or using BuyerLens, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract. BuyerLens is designed for use in relation to Australian residential property.

2. What BuyerLens is — and is not

BuyerLens is a self-service research and education platform. It provides data, calculators, AI-generated guidance and a structured buying process so that you can research and manage a property purchase yourself.

BuyerLens is not a licensed buyer's agent, real estate agent, financial adviser, credit adviser, mortgage broker, accountant, tax agent, conveyancer or solicitor. We do not act on your behalf, and we do not search, negotiate, bid, transact or sign anything for you. Nothing in BuyerLens constitutes personal financial, credit, tax, legal or investment advice, and it does not take into account your personal objectives, financial situation or needs. Before making any property, finance or tax decision, obtain advice from appropriately licensed professionals.

3. Accounts

Your account is personal to you. You must not share, sell or transfer access. You are responsible for keeping your login details secure and for activity under your account. Notify us promptly of any unauthorised use.

4. Subscriptions, billing and the Purchase Tracker

• BuyerLens is offered on monthly subscription plans (currently Investor and Research Pro), in Australian dollars. Applicable taxes are included or added as required by law.
• A paid subscription is required before the research platform can be accessed. BuyerLens does not offer a free trial.
• Subscriptions renew automatically each month until cancelled. You can cancel at any time from your billing portal; your access continues until the end of the period you have paid for.
• Some features (including the Purchase Tracker and its email reminders) are available only on the Research Pro plan. Risk Check and Find a Pro are included only while their external source connections are enabled. Hazard-map coverage is incomplete, differs by jurisdiction and can become unavailable; “not assessed” does not mean low or no risk.
• Plan allowances: each plan includes fair-use allowances, including Research Coach message limits (daily and monthly) and a monthly market-data allowance covering third-party data lookups. When an allowance is used up, the relevant feature pauses until it resets (daily or on the 1st of the month). Allowances are set generously for genuine personal research; we may adjust them to keep the service sustainable and will notify you of any material reduction.
• Complimentary or promotional access may be time-limited and ends on its stated expiry unless a paid subscription is started.
• Payments are processed by Stripe and subject to Stripe's terms.

5. Cancellations and refunds

You can cancel at any time, and access continues until the end of the period you have paid for. We do not provide change-of-mind refunds or a free trial, except where required by law or expressly agreed by us. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

6. Purchase Tracker and reminders

The Purchase Tracker is an organisation and reminder tool only. Any dates, checklists, cooling-off guidance and reminders are general and indicative, may be incomplete or out of date, and vary by state and by contract (for example, cooling-off rights differ between states and generally do not apply to auction purchases). You are solely responsible for confirming and meeting your actual dates and obligations with your conveyancer, solicitor, lender and other advisers. We are not liable for any missed date, deadline or obligation.

7. Data and accuracy

Market data, statistics and recent-sales information are sourced from third parties (including HtAG Analytics, the Australian Bureau of Statistics and state government sources) and are provided "as is". BuyerLens does not provide live property listings; where relevant it links to third-party listing portals, whose content is their own. Calculator outputs and AI-generated content are estimates based on the inputs and assumptions used (including current tax and stamp duty settings, which change over time), may contain errors, and are not guaranteed to be accurate, complete or current. Past performance is not an indicator of future performance. You should independently verify any figure before relying on it.

7A. Research Cases, scenarios and dossiers

A Research Case is a private organisational record created from criteria, notes and decisions you enter, together with selected data snapshots and calculations. Candidate classifications, comparison tables, stress scenarios, break-even figures, checklists and dossiers are research aids only. They are not valuations, forecasts, suitability assessments, professional reports or recommendations to acquire a property.

A dossier is labelled as prepared by the user using BuyerLens research tools. You are responsible for checking its contents and deciding whether to provide it to a licensed professional. Completion of a checklist does not establish that due diligence is complete or that a property is safe or suitable.

8. Acceptable use

You agree not to misuse BuyerLens, including by attempting to access it unlawfully, sharing account access, scraping or bulk-extracting data, systematically capturing subscriber-only screens or workflows, reselling or redistributing data or outputs, reverse engineering the service, reproducing non-public ranking logic or prompts, using subscriber access to build or train a competing service, or using BuyerLens in breach of any third-party data provider's terms. This does not restrict conduct that cannot lawfully be restricted.

9. Intellectual property

BuyerLens and its content, design, non-public methods, prompts, workflows and software are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use BuyerLens and to retain ordinary outputs for your own personal, non-commercial property research while your subscription is active. No source code, ranking implementation, data licence or other intellectual-property right is transferred to you.

10. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, BuyerLens is provided "as is", and to the maximum extent permitted by law we exclude all other warranties and are not liable for any indirect or consequential loss, or for any loss arising from your reliance on data, calculations, AI output, reminders or guidance. To the extent we are permitted to limit our liability, our total liability is limited to the amount you paid us in the 3 months before the relevant claim.

11. Indemnity

You agree to indemnify us against claims arising from your misuse of BuyerLens or your breach of these Terms.

12. Suspension and termination

You may stop using BuyerLens and cancel at any time. We may suspend or terminate access if you breach these Terms, do not have an active subscription, or where suspension is reasonably necessary to protect BuyerLens, its users, intellectual property or licensed data. Disabled accounts cannot log in or access subscriber content. On termination, your right to use BuyerLens ends.

13. Changes

We may update these Terms or the service from time to time. We will post the updated Terms here and change the "Last updated" date. Continued use after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
